A. Cancellation Policy
Introduction
Consumers are entitled to a right of cancellation in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity:
Right of Cancellation
You have the right to cancel this contract within 100 days without giving any reason.
The cancellation period is 100 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.
To exercise your right of cancellation, you must inform us (Revay GmbH, Straße der Einheit 31, 09337 Hohenstein-Ernstthal, Germany, Tel.: 03723 6295645, E-Mail: support@peachyboots.com) of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the attached model cancellation form, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send the notification regarding the exercise of the right of cancellation before the cancellation period has expired.
Effects of Cancellation
If you cancel this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You shall bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
Exclusion or premature expiry of the right of cancellation
The right of cancellation does not apply to consumers who do not belong to a member state of the European Union at the time the contract is concluded and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.
Linked/financed transactions
If you finance this contract with a loan and later cancel it, you are no longer bound by the loan agreement if both contracts form an economic unit. This is to be assumed in particular if we are simultaneously your lender or if your lender makes use of our cooperation with regard to the financing. If we have already received the loan when the cancellation takes effect or when the goods are returned, your lender shall succeed to our rights and obligations under the financed contract in relation to you with regard to the legal consequences of the cancellation or return. The latter does not apply if the present contract involves the acquisition of financial instruments (e.g. securities, foreign exchange or derivatives). If you wish to avoid a contractual obligation as far as possible, make use of your right of cancellation and also cancel the loan agreement if you have a right of cancellation for that as well.
General Information
1) Please avoid damage and contamination of the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer possess the original packaging, please provide sufficient protection against transport damage with suitable packaging.
2) Please do not send the goods back to us freight forward (unpaid).
3) Please note that the aforementioned points 1-2 are not a prerequisite for the effective exercise of the right of cancellation.
